Who Speaks for You?

Unlike some other states that have a “one bite” rule, North Carolina holds dog owners liable for bites and other injuries caused by their animals. In other words, you don’t have to prove that the owner was negligent as long as their dog caused a “severe injury.”

Statute of Limitations for Injury Claims in North Carolina

North Carolina law allows only Three Years to file a personal injury claim. This deadline is critical to your rights because if you don’t get your lawsuit started in court before North Carolina’s three-year filing window closes, you’ll lose your right to have your case heard. Call our offices today to avoid missing your window of opportunity.

It is illegal for a dog owner to:

  • Leave a dangerous dog unattended on the owner’s real property unless the dog is confined indoors, in a securely enclosed and locked pen, or in another structure designed to restrain the dog; or
  • Permit a dangerous dog to go beyond the owner’s real property unless the dog is leashed and muzzled or otherwise securely restrained.

A potentially dangerous dog is determined to have:

  • Inflicted a bite on a person that resulted in broken bones or disfiguring lacerations or required cosmetic surgery or hospitalization
  • Killed or inflicted severe injury upon a domestic animal when not on the owner’s real property; or
  • Approached a person when not on the owner’s property in a vicious or terrorizing manner in an apparent attitude of attack.

A dangerous dog is defined as a dog that has killed or inflicted severe injury on a person.

What to do if you’ve been injured in an accident:

  1. Report your accident to the appropriate authorities ASAP. Whether this is the police, an employer, a store employee, or a supervisor. Get medical treatment for any injuries you have sustained, don’t “shake it off.” Some injuries, like traumatic brain injuries or internal injuries, can have delayed symptoms. The sooner you can receive medical attention, the better for your health and your case.
  2. Collect as much information as possible. Either you or someone you trust should attempt to get information from any involved parties. Important information can be the names of all parties involved and any eyewitnesses. If you were in a car crash, get the other driver’s insurance information too.
  3. Take photographs. Photograph the scene, your injuries, the causing factors of the accident, and anything you think may be relevant. If you were injured on someone’s property due to a dangerous condition, take photos of the dangerous condition.
  4. Get copies of all relevant documents. This can include police reports, incident reports, medical documents, and communications with insurance companies.

The more information you have about your case, the stronger your claim will be. If you were injured due to another’s carelessness, contact one of our experienced North Carolina Personal Injury lawyers to learn more about filing a claim.

Should I Get A Dog Bite Lawyer?

Being the victim of a dog bite is a traumatic experience and one that many people share. Approximately 5 million people are bitten by dogs each year in the United States, and sadly, roughly half of those victims are innocent children. Most often, people are attacked by dogs they know, such as a neighbor’s dog or a family friend’s dog, although it’s also possible to suffer an attack from an unfamiliar dog. If you are the victim of a dog bite, you likely have mounting medical bills and months or years of recovery in front of you.

Filing a claim against the responsible party is necessary, so you can focus on your recovery instead of the financial ramifications of your injury. Call our dog bite attorneys today.
